License Agreement

Clickwill alpha, End User License Agreement. Version 1.0, effective 3 October 2026.

This agreement is concluded between you and Jakub Warzecha, a natural person, e-mail: clickwilldev@protonmail.com (the "Licensor"). It governs the alpha version of Clickwill made available free of charge at clickwilldev.com (the "Software"). By installing or using the Software you accept this agreement. If you do not accept it, do not install or use the Software.

1. License grant

The Licensor grants you a personal, non-exclusive, non-transferable, revocable and royalty-free license to install and use the Software on computers that you own or control, for your own non-commercial use and for the purpose of testing the Software.

2. Restrictions

You may not: (a) distribute, publish, sell, rent, lease, sublicense or otherwise make the Software available to any third party, including by uploading it to any website, file-sharing service or code repository; (b) remove or alter any notice contained in the Software; (c) use the Software to provide a service to third parties. The Software may be obtained only from clickwilldev.com. Decompilation for the purpose of interoperability is not restricted to the extent permitted by applicable law.

3. Your device and content

You represent that you own or control the iPod device you use with the Software and that you are entitled to modify its contents. You are solely responsible for the content stored on the device and for maintaining backup copies of any content you value.

4. Operation of the Software

The Software reads and writes data files on the mass-storage volume of the device. It does not modify the device's firmware, does not circumvent any technical protection measure and does not require or perform any jailbreak. Before each write it creates a backup and after each write it verifies the result by reading it back. A full description is available in the About panel of the Software.

5. Test version

The Software is a test version. It may contain errors, may be incomplete and may behave differently from any later version. The Licensor may modify, suspend or discontinue the Software, or the delivery of updates to it, at any time. Writing to devices other than the iPod classic is not supported in this version.

6. Updates and feedback

The Software may check clickwilldev.com for updates as described in the Privacy Policy. Any feedback you send to the Licensor may be used to improve the Software without any obligation to you.

7. No warranty

The Software is provided free of charge. To the fullest extent permitted by applicable law, it is provided "as is" and "as available", without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. The Licensor does not warrant that the Software will operate with every device, firmware version or file, or that it will be free of errors.

8. Limitation of liability

To the fullest extent permitted by applicable law, the Licensor shall not be liable for any damage arising from or in connection with the use of the Software, including loss of data or of music files. This limitation does not apply to liability which cannot be limited or excluded under applicable law, including liability for damage caused intentionally or by gross negligence and liability for death or personal injury.

9. Consumer rights

Nothing in this agreement limits any right you have as a consumer under the mandatory law of the country in which you reside.

10. Trademarks

Apple, iPod, iPod classic, Click Wheel, Cover Flow, iTunes, Apple Music, Mac and macOS are trademarks of Apple Inc. Clickwill is not affiliated with or endorsed by Apple Inc. Album artwork, titles and artist names shown on the website belong to their respective owners. This agreement grants you no rights in any trademark.

11. Termination

This agreement terminates automatically if you breach it. On termination you must cease using the Software and delete all copies of it. Sections 3 and 7 to 12 survive termination.

12. Governing law

This agreement is governed by the law of Poland, without prejudice to the mandatory consumer protection provisions of the country in which you reside. If any provision of this agreement is held unenforceable, the remaining provisions remain in full force and effect. This agreement constitutes the entire agreement between you and the Licensor concerning the Software.
